日商兄弟工業股份有限公司根據世界各地之不同需求，提供給消費者不同規格產品。因此在國外所銷售之本公司碳粉匣，某些規格產品可能無法適用於本公司於台灣所銷售之印表機。

近來，本公司發現，有業者於平行輸入本公司美國規格碳粉匣後，為使能適用於本公司台灣規格之印表機，竟將碳粉匣予以加工後出售。

本公司取得該業者樣品後進行印刷測試後發現，其印刷品質與本公司之正規品有所差異。

本公司嗣對該業者以商標侵害為由，向台灣臺北地方法院檢察署提起刑事告訴，經台灣臺北地方法院檢察署調查後，日前已將該業者負責人以違反商標法為由提起公訴。

從國外進口本公司產品予以加工後銷售時，品質上可能產生變異之虞，本公司就此無法保證其品質。

本公司為保障自身及消費者權益，今後將繼續關注包含台灣在內之市場上動態，一旦發現有不法行為，將採取斷然措施予以因應。

BROTHER INDUSTRIES, LTD. (hereafter "BROTHER") provides and markets products of different types of specifications so as to fulfill diverse needs for customers in different regions of the world. Therefore, the toner cartridges marketed by BROTHER. overseas cannot be used compatibly with BROTHER's printers marketed specifically in the Taiwan region. 

Recently, BROTHER found that a Taiwanese company has parallel imported BROTHER's toner cartridges from U.S. into Taiwan, further modified such toner cartridges in order to be installed into the BROTHER's printers marketed specifically for the Taiwan market, and then sold the modified toner cartridges to customers .

Having tested the modified toner cartridges purchased directly from the aforementioned party, BROTHER notes that the test outcome shows a difference from BROTHER's regular product.

BROTHER has filed a criminal complaint with the Taipei District Prosecutors Office against the aforementioned company.  Having completed the investigation thereto, the Taipei District Prosecutors Office brought the owner of such Taiwanese company under indictment for violation of the Taiwan Trademark Act. 

Modification of the products may result in degradation of product quality.  Therefore, BROTHER cannot guarantee the quality of such modified parallel imports. 

To protect the rightful interests of BROTHER and customers, BROTHER will continue to globally monitor products on the market, including Taiwan, and shall take all necessary actions if any misconduct or unlawful acts are discovered.
